BUYER'S ACCOUNT · DOCUMENTS AND RESPONSES

Contract, compensation promises and further purchases

The buyer says he continued purchasing after receiving commitments to compensate earlier losses. He says those promises proved false or went unfulfilled, that losses remain unremedied, and that reliance on them led to approximately USD 500,000 in additional purchases. This is his account of the dispute; the additional-purchase amount still requires documentary reconciliation.

That account is compared here with December 2025 messages, different contract versions, an October 2026 email and material forwarded to the VIP group in November. Supplier responses are retained, and purchases, claimed compensation and quantified losses are kept distinct.

CONTRACT · COMPENSATION · RELIANCE IN FURTHER BUYING

The sequence behind the claim

The claim and what the sources establish

The buyer’s account

The dispute extends beyond a port charge: the buyer links earlier losses, compensation promises, continued purchasing and new costs. He says the prospect of compensation was central to his decision to keep buying and that it was not delivered.

What has documentary support

There is a written compensation claim from December 2025, a reply assigning contract and compensation handling to a representative, differing contract versions, and the buyer’s October 2026 email explaining why he kept purchasing.

What remains unresolved

The accepted commitment, authorized contract version, compensation actually applied, and the distinct orders and payments supporting further purchases still need to be established. The reviewed sources do not determine intent, authenticity or liability.

Why the buyer says he kept purchasing

On October 8, 2026, the buyer emailed the supplier that commitments communicated to him differed from what the other party knew, particularly regarding compensation for losses. He added that he had agreed to keep purchasing on that understanding. This written explanation predates this page update; it is not presented as the other party’s acceptance.

Approximately USD 500,000 in additional purchases: a statement to reconcile

The buyer estimates the additional purchases he attributes to that reliance at approximately USD 500,000. One recovered contract identifies a USD 272,500 order; that alone does not establish the additional total or justify adding versions of the same order, advances or potentially related receipts. A purchase value does not automatically become a loss.

Messages and documents in context

  1. December 17, 2025

The buyer says USD 1,000 per container had been agreed as compensation, refers to an earlier account of about 80k and another 5k for the latest receipt. He requests recognition of compensation and proposes reducing the order. These are his messages; writing the figures does not settle them.

  2. The same December sequence

A correspondent replies that a representative handled the transaction, including contract, price, compensation, goods payment and continued cooperation. The final sentence about authorization is cut off in the capture and is not completed here.

    E48
  3. January 2026

A supplier email containing a General Contract and annexes was recovered. Its wording on indemnity and other terms differs from the retained scan. It is recorded as another version without equating them.

    E49
  4. March 2026

A capture dated March 2 shows a 13-page PDF and requests for a Word version with tracked changes. The reply says “this is contract.” An archived March 4 email links the digital file. Both dates are retained without assuming they establish a single event.

    E49 / E50
  5. March 19, year not visible

Another capture contains a reply announcing preparation of the contract, a courier label and a message about dispatch. This favorable context is retained: the account does not allege that no contract was ever sent or that the label proves its contents or receipt.

    E50
  6. October 8, 2026

The buyer explains by email that he agreed to keep purchasing on the understanding that compensation would be provided. The message documents his position, not supplier approval or reconciliation of every purchase.

The contract is part of the dispute

Documents with different wording were recovered. The dispute includes which version was sent and authorized, its connection to each order, and which commitments remained unfulfilled.

Recovered documentDifference requiring review
59-page scanContains the contractual body, annexes, and visible signatures and stamps. Its indemnity formula is broader than other recovered versions. Visible marks and stamps do not alone authenticate authorization or consent.
13-page digital versionSent in an archived email. A March capture lists a file with the same name and page count; the conversation attachment has not been fully compared. Indemnity wording and the late-delivery penalty period do not fully match the scan.
General Contract with annexes, 31 pagesA January 2026 dispatch is retained. Wording on spare parts, losses and earlier payments differs from the other versions. It is not treated as their automatic replacement.

Full contracts, signatures, stamps, addresses and banking details remain private. Authorization, confidentiality and the applicable version remain under review; this page makes no finding of forgery or invalidity.

The central contract questions

The dispute requires answers based on complete documents and communications:

  • Which version was sent and accepted for each order?
  • Who prepared, signed and authorized the circulated contract?
  • What compensation was accepted, and how was it applied, paid or replaced?
  • Which later purchases were made in reliance on those commitments?

Purchases, compensation and losses are different accounts

Historical compensation claimed
Messages refer to earlier losses and per-container compensation. The original agreement, credits, discounts, replacements and outstanding balance require reconciliation.
Further purchases alleged
The approximately USD 500,000 is the buyer’s current estimate of additional purchases. It is not added as a loss or presented as a verified total of payments.
2026 cost and loss schedule
The 13-item base and five additional items retain MXN 1,337,059.09 as the proposed total, with its reservations. This narrative does not increase that schedule.

  • Invoice 3686 describes a partial cutoff, while the schedule calls it final. Entry C07 retains this discrepancy.
  • The MXN 185,020 in NOM services do not by themselves establish formal cancellation, replacement cost or the loss of use of the entire portfolio reported by the buyer.

MXN 39,000.00

The two invoices total MXN 29,555.46; base plus those invoices: MXN 1,281,457.15. The latest schedule adds three other items totaling MXN 55,601.94 to propose MXN 1,337,059.09. The USD 720 charge is communicated by email, which says the shipper undertook to pay it: it is not automatically attributed to Color, and final payment is not established here. The agent-change pro forma is not a finally paid invoice either. These are different levels of support, not acknowledged losses.

The latest schedule includes MXN 39,000 in handling, shown here with a reservation. The MXN 85,800 advance already includes the MXN 36,000 pre-clearance check and MXN 10,800 customs examination in the base; the entire advance is not added again. The MXN 39,000 still needs to be reconciled against MXN 75,000 in handling in earlier budgets; they have not yet been established as distinct charges.

File timeline

A summary of documents and communications described in the buyer’s file. A year inferred from context, rather than visible in a screenshot, is not treated as a verified date.

  1. March 2026

The buyer reports errors in manuals. The representative’s response is also retained: she did not see blank pages or displaced images on her device.

    C02
  2. May 20–21, 2026

The origin inspection records scratches, dust and packaging and identification observations. It does not establish ten damaged machines or their condition on arrival in Mexico.

    C24
  3. June–July 2026

The file records document requests and later delivery of invoices, lists and test files. Sending a file does not establish adequacy; the account also does not say that no documents were sent.

    C08
  4. July–August 2026

The buyer links documentation discrepancies, checks and port costs across two operations. The cause and attribution of each billed day remain unresolved.

    C04
  5. August 2026

Advances, storage amounts and NOM services are recorded. A reduction from three storage weeks to two was accepted; final application still requires reconciliation.

    C09
  6. September 2026

Demurrage invoices, a receipt of payment application and additional shipping charges are added. Balances at a historical cutoff do not establish current debt.

    C07
  7. October 2026

The buyer reports affected use of certifications and being told to apply again when changing trading company. Scope, replacement and causation remain open.

    C17
  8. November 4–5, 2026

The file incorporates a 13-item base followed by a schedule with five additions. Versions, items subject to reservations and claims at different cutoffs are distinguished to prevent counting them twice.

How to read payments and vouchers

A payment CFDI documents the joint application of USD 12,249.60 to invoices 3607 and 3608. Other vouchers state that the transaction was being validated and applied. Funding transfers are not automatically treated as individual payment of every charge or as a loss.

The material reviewed is not a final settlement and does not by itself establish the individual application of every payment. Funding lists in different deliveries also cover different scopes; they are therefore not presented as a single closed account.

Correspondence cross-check

Five textual WhatsApp Web captures were reviewed. Four warn that coverage is partial; one describes a sweep of its group as of extraction. They are not an authenticated native export and do not include the files, photos or recordings they list. Written dates, rather than row positions, determine the reading order.

These texts add no verified expenses to the 18-item schedule. Quotations, equipment prices, forwarded claims and per-certificate values mentioned in messages are not treated as payments, confirmed purchases or additional losses.

Communication of the claim and request for clarification

T01 · November 4–5, 2026

The group transcript records a claim, a list of files and the historical amount of approximately USD 69,500 for 2026, plus a separate statement concerning 2024.

Response and context

The account attributed to the supplier first replied with a greeting and then asked what the material meant. These responses are retained and are not read as acceptance of the amount or liability.

Limits of this material

Attachments are listed, not included in this ZIP. A forwarding caption or filename does not verify content or establish payment. An intermediary’s claim is not incorporated.

E43
Conditional quotations and disagreement over prices

T02 · October 21–31, 2026

The buying team describes new proposals subject to approval. Later it says a proposal does not match its request and that some prices rise by up to 50%. That disagreement is recorded as the team’s statement.

Response and context

One correspondent says she sent products and prices; catalog and list titles also appear in the transcript.

Limits of this material

Quotation versions still need comparison to verify prices, comparability and acceptance. Confirmed orders, lost sales and the contents of listed files are not established. This correspondent is not equated with those in other groups.

E45
Reported black screen when using a camera

T03 · October 7–8, 2026

The requesting team reports that an arm-wrestling machine’s screen goes black when it attempts to take a photo and asks for technical guidance.

Response and context

The support account proposes checking connections; the team says it will try the suggestion and report the result.

Limits of this material

The text establishes a question and a response, not a confirmed diagnosis, completed repair or cost. The video mentioned is not included.

E44
Question about an impact mechanism

T04 · October 26–27, 2026

Another request describes an issue with the impact mechanism of a hammer game.

Response and context

The team is told an engineer will assess the situation and is asked about a possible hit by a user. These alternative explanations are retained as responses, not established facts.

Limits of this material

No technical outcome, manufacturing cause or repair expense is established here. This report is not merged with the screw question in another chat.

E44
Continuous movement in jumping games

T05 · October 26–November 4, 2026

The transcript contains a report presented as a second case involving a different machine, with continuous movement and no menu access. On November 4, the team reports continued movement after more than four hours without credits.

Response and context

Support suggests accumulated credits and later writes “Changed to free games,” without clarifying whether this is an instruction, a completed change or a description of the setting. An invoice is also requested in the same chat to check warranty coverage; that message does not identify the model.

Limits of this material

Neither cause nor an effective resolution is established. Distinct units are not merged, and uncertain recollections do not establish a receipt date, serial number or shipment. The invoice request is retained as chat context without assigning it to this machine; it is neither a warranty rejection nor proof that warranty was applied.

E44
Another question: a possibly loose screw

T06 · October 30, 2026

A different transcript records a request for guidance on repairing a machine.

Response and context

The support account suggests that a screw may be loose inside the cabinet.

Limits of this material

The text does not identify the model, and the explanation is tentative. This case is not assigned to the hammer game, nor does it establish diagnosis, repair or economic loss.

E46
Requested technical material and recorded responses

T07 · August–October 2026

The transcripts record requests for manuals, videos, editable files and measurements. They list manual files and responses with technical information; some measurements are described as approximate.

Response and context

Deliveries and offered assistance are retained. For one specific manual, an account says the product did not originate from its company and that it does not have the corresponding manual.

Limits of this material

The account does not allege a complete absence of support. Files are not in this ZIP and adequacy has not been checked. Sharing a group does not assign every model to one supplier. These responses are not imported into the catalog as verified commercial specifications.

E44 / E47

Only anonymized summaries appear here. Names, telephone numbers, original group titles, audio, images, files and personal remarks remain outside the website. These transcripts alone cannot approve images or verify identity or authenticity.

What still needs reconciliation

  • Final shipping-line, terminal and customs-operation settlements, including later cutoffs and inconsistent container references.
  • Individual payment application, charges still being validated and the MXN 39,000 handling amount pending review.
  • Affected certificates and models, reported loss of use, validity, use through another trading company and the actual replacement cost of the entire portfolio.
  • Causation of each expense and the effect the buyer attributes to one operation’s incidents on other operations. Distinct companies and representatives are not conflated.
  • Receipt of machines in Mexico, shortages actually received and documented repair costs.
  • Opportunities and purchasing capacity the buyer says were lost, without treating planned purchases as realized losses.

The buyer also refers to USD 80,000 concerning 2024 in its November 4 communication. That historical claim remains separate from the 2026 schedule and requires its own breakdown, support and scope. It is not automatically added to the displayed total.

Origin inspection: scratches, dust and carton sealing

Photographs from the origin inspection of May 20 and 21, 2026, document scratches on handles, housings and product bodies, and dust on surfaces. On the packaging, they document poorly sealed carton lids and a tear in the hand hole of one box. The inspector's table records six minor scratch observations and four major observations for carton sealing.

These are observations on the samples inspected at origin; the ten observations in the table do not equal ten damaged machines. The report does not state order or sample quantities, does not give an overall verdict and does not include complete functional tests. The percentages for dust and broken handles cited in the report do not state the total on which they were calculated. None of this is extrapolated to the batch as a whole, to the condition on arrival in Mexico or to a repair cost.

Three invoices for the Color operation total USD 9,831 including VAT: USD 6,635.20 and USD 2,041.60 for demurrage, and USD 1,154.20 for other carrier charges at destination. A receipt records the application of USD 6,635.20. The account statement of October 13 shows USD 3,195.80 outstanding at that date.

That balance is historical and does not determine the current debt. The USD 1,154.20 has a generic description and is not reclassified as demurrage. Six files are not six certificates. The inventory does not establish validity, authenticity, coverage of all models or resolution of the losses claimed. The originals and their holders' data remain private.

Claim and reconciliation

USD 70,000 claim communicated by the buyer

The buyer claims USD 70,000 in damages and confirmed the currency on November 4, 2026. It is the buyer's claim: not a reconciled figure and not one acknowledged by the supplier side.

The earlier USD 50,000 claim is not added to the current one. The amounts on this page — invoices, certification, quotes and communicated charges — are shown separately to avoid double counting and are neither a cap nor a total of the damages: reconciliation remains open.

Evidence and privacy

Original documents and screenshots remain private. This page contains summaries and six permanently redacted excerpts, without faces, contact details or recordings; it serves no originals. Statements are attributed to their sources and distinguished from established findings. The English and Chinese versions are working translations of the Spanish text.
